By using the Website, you agree to use the Website in accordance with these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Website or to products and services available on or through the Website. If you do not agree to these terms, please exit the Website immediately. WatchEnthusiasts LLC reserves the right to change these terms at any time without notice. In addition to these terms, when using a particular WatchEnthusiasts LLC product or service online, you and WatchEnthusiasts LLC may also be subject to any additional posted guidelines, terms, rules or restrictions applicable to such product or service.

You acknowledge and agree that by accessing the Website that this is a legally binding agreement between you and WatchEnthusiasts LLC supported by reasonable and valuable consideration, and that you have read these terms carefully.

The Website is a product of WatchEnthusiasts LLC. You understand and acknowledge that WatchEnthusiasts LLC owns all right title and interest to the Website and all proprietary rights associated therewith and reserves all rights not specifically granted herein.

Use License

In order to maintain an informative and valuable service that meets the needs of the users of the Website and avoids the harm that can result from disseminating statements that are false, malicious, in violation of the rights of others, or otherwise harmful, it is necessary to establish the following rules to protect against abuse.

• Use the Website to post, transmit or in any way exploit any information, software or other material for commercial purposes, or that contains advertising.
• Use the Website to advertise or solicit to anyone to buy or sell products or services, to cease using the Website, to visit another competing Website, or to make donations of any kind, without our express written approval.
• Gather for marketing purposes any email addresses or other personal information that has been posted by other users of the Website.

WatchCharts Premium

You may not use WatchCharts Enthusiast, Insider, or Professional plans (“WatchCharts Premium” or “Premium Services”) without a valid subscription to WatchCharts. To obtain a subscription, you must register for the Premium Service by completing the online registration form available on the Website. You may receive a seven (7) day trial subscription to WatchCharts Premium, beginning on the date on which WatchCharts accepts your subscription. If you receive a trial subscription but do not terminate your subscription during this trial period, the initial term of your regular service subscription will start immediately after the seven (7) day trial period ends and will continue until it is terminated. If you have taken a trial for the same membership in the past, you will not receive a seven (7) day trial and your account will be charged immediately. Each individual or entity is entitled to only one free trial for our services. We reserve the right to modify or terminate free trial offers at any time without notice. This may include changes to the duration, features, and eligibility requirements of such trials. By signing up for a free trial, you agree to a $1 authorization charge for the purpose of verifying the validity of your payment method; this charge is temporary and will be refunded immediately.

Cancellation and refund policy. If you cancel before the end of the 7-day trial, and we will not charge your credit card. After the subscription begins, we offer a 30-day money back guarantee. After that, you may cancel within 6 months, and we will give you a pro-rated refund. No refund will be given if you cancel after 6 months of the subscription. The amount you will not be refunded is based on the number of months multiplied by the monthly membership rate. No refund is available for monthly subscriptions. Certain processing fees may apply.

The initial minimum subscription payment term is 12 months for annual plans, and 1 month for monthly plans. You will be charged at the beginning of each subscription term, which covers the full term of services. You understand that, unless you notify us that you wish to terminate your subscription before the end of your then-current subscription term, your subscription will continue to automatically renew for successive terms of the same duration and account will be charged for each such renewal at the subscription fee in effect at the time of that renewal. The term “subscription term” shall refer to the term of your subscription then in effect, regardless of whether it is the initial term or any renewal of that term.

Any subscription to a Premium Service is exclusively for personal or professional research purposes and must be used solely by the person who purchased the subscription. It may not be utilized to build an application intended for use by end-users other than for you. You must disclose in any printed or shared document containing the WatchCharts data either the WatchCharts logo or reference that the data is from WatchCharts.

Use of Data

WatchCharts membership does not grant you the rights to redistribute and/or resell WatchCharts data. If you want to redistribute or resell any data on the Website in any format, you need to obtain the proper data license from WatchCharts. The following data usage terms apply to all data published by WatchEnthusiasts LLC, including on watchcharts.com, marketplace.watchcharts.com, and through the WatchCharts API (api.watchcharts.com).

Data Ownership and Confidentiality. All data, including but not limited to, user-generated content, reports, statistics, and analysis generated on or through our platform, remains the proprietary information of WatchEnthusiasts LLC. Unless you have our express written consent to distribute our data, it is considered confidential and intended for personal or internal business use only. It is not to be used for commercial exploitation, including resale, lease, or provision to third parties in any form, with our express written consent. This restriction applies irrespective of whether the data is in its original form or has been transformed or amalgamated with other data.

Prohibition on Redistribution. Users are strictly prohibited from redistributing, sharing, or displaying any data obtained from our platform to third parties or the public without the express written consent of WatchEnthusiasts LLC. This includes, but is not limited to, any form of reproduction, publication, broadcasting, and posting on external websites, apps, or social media platforms.

Enforcement and Consequences of Violation. Any unauthorized use, distribution, or display of data from our platform will be considered a breach of these terms. We reserve the right to take appropriate legal action, including but not limited to, termination of your account, legal claims for damages, and/or injunctive relief.

WatchCharts Marketplace Listings

The listings displayed by the Website are created by people over whom WatchEnthusiasts LLC exercise no control. You acknowledge and understand that we have no control over the listings or other information posted therein. Listings displayed by the Website are displayed in an automated manner and are not screened by the Website. WatchEnthusiasts LLC cannot confirm that the sellers who created the listings are who they are or who they claim to be. WatchEnthusiasts LLC assumes no responsibility, and disclaims all liability, for the content, accuracy, completeness, legality, reliability, or availability of any listing, item, information, or website that is displayed the Website. Each listing, including the information and images contained therein, is copyrighted by its respective owner(s).

The Website contain links to other sites on the Internet which are owned and operated by third party vendors and other third parties (the “External Sites”). You acknowledge that WatchEnthusiasts LLC is not responsible for the availability of, or the materials located on or through any External Sites. WatchCharts Marketplace Submissions

By posting/sending a message in any public electronic forum on the Web Site, you agree to have that message along with your name and/or user name posted for public viewing without compensation. By using “Ask Cog”, our artificial intelligence watch assistant tool, you acknowledge that WatchEnthusiasts LLC may retain a copy of your chat log to improve our service, in accordance with our privacy policy.

Your use of the Website is solely at your own risk.
